if you were playing of the Wii/Wii U with the WiiMote on WITHOUT the safety strap, and the WiiMote flies out of your hand and hits someone and kills them, who would be pressed with charges? You, Nintendo, or the person in the room with you?

You for doing the murder?

Nintendo for being Nintendo?

Or the person in the room with you because they were in the same room as someone not wearing the WiiMote safety strap?

I think it'd be the person in the room with you attempting to commit suicide (and succeeding), and if found guilty would be sentenced to death.
